Mr. Chitrarth Kandpal, learned Brief Holder for the State of Uttarakhand. 3. Heard learned counsel for the Applicant and learned A.G.A. for the State. Perused the record. 4. Learned counsel for the Applicant submits that there is no independent witness and the Applicant has been falsely implicated in the present case. It is further submitted that the Applicant is languishing in jail since 18.02.2026 and has no previous criminal history or conviction to his credit. It is also submitted that the grounds of arrest were not communicated to the Applicant. Learned counsel further submits that the Applicant has neither cheated the informant in any manner nor fraudulently prepared any document, as alleged by the prosecution; hence, prima facie no offence under Section 318(2) of the B.N.S., 2023 is made out against the Applicant. 5. Per contra, learned A.G.A. opposed the Bail Application. 6. After hearing learned counsel for the parties and upon perusal of the material available on record, this Court finds that, without expressing any opinion on the merits of the case, the Applicant has made out a fit case for grant of bail. 7. Accordingly, the Bail Application is allowed. 8. Let the Applicant—Chetan Kumar be released on bail upon furnishing a personal bond and two reliable sureties, each in the like amount, to the satisfaction of the court concerned. 9. It is made clear that any observation made hereinabove is only for the purpose of adjudication of the present Bail Application and shall not be construed as an expression on the merits of the case. 10.
