JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayer: “a) Issue a Writ of Mandamus directing the Respondents No.2 to 4 to consider the representation by the petitioner Ref.SSL/Legal/25-26/4752 dated 09.12.2025 and enhance the allocation of the supply of Ethanol produced vide ANNEXURE-E. b) Pass such other orders as this Hon’ble court deems fit in the interests of justice and equity.” 2. It is the case of the writ petitioner that the petitioner is an integrated sugar factory engaged in the manufacturing of sugar, co-gen power and has also established a distillery. The petitioner herein has established a dedicated ethanol plant for the manufacturing and supply of the Denatured Andydrous Ethanol for the purpose of supply to the oil marketing companies, i.e. respondent no. 2 to 4. 3. The grievance of the writ petitioner is that the allotment made to the petitioner for ESY 2025-26 is substantially lower than the quantity of ethanol that will be produced only from the raw materials in relation to which agreements have been - 4 - HC-KAR NC: 2026:KHC-D:2570 WP No. 101077 of 2026 executed without even taking into account its total annual design capacity which is considerably higher. Hence the petitioner has given a representation dated 09.12.2025 to respondents No. 2 to 4 seeking inter alia enhancement in the allocation of quantity of supply of ethanol for years by 2025-2026 pursuant to the tender bearing number 22376 dated 23.09.2025. 4. It is the grievance of the petitioner that no positive action has been taken by the respondent’s No. 2 to 4 even till today. Hence the petitioner is constrained to approach this court by filing the present writ petition. 5. Learned counsel appearing for the respondents no. 2 to 4 submits that though the representation is dated 09.12.2025 but the same was dispatched on 23.01.2026 and immediately the petition is filed. 6. The petitioner has given a representation to the respondents. The respondent Nos.2 to 4 ought to have considered the same in accordance with law and they cannot keep quiet by just receiving the representation. In that view of the matter, this Court is passing the following: - 5 - HC-KAR NC: 2026:KHC-D:2570 WP No. 101077 of 2026 ORDER i. Accordingly, the writ petition is disposed of directing the respondents to consider the representations dated 09.12.2025 in accordance with law within a period of 2 weeks from the date of receipt of the copy of the order. ii.
