No.427 OF 2009 THE HON’BLE SRI JUSTICE SUBHENDU SAMANTA CRIMINAL REVISION CASE NO: 427/2009 ORDER: 1. Instant criminal revision has been preferred against the order dated 20.12.2008 passed by learned I Additional Judicial First Class Magistrate at Tenali in C.F.R. No.225 of 2008 in Crime No.112 of 2007 of Tenali I town police station. 2. None appears on behalf of the petitioner. 3. During pendency of the revision, pursuant to the direction of this Court, dated 30.06.2025, the Station House Officer, Tenali I Town Police Station, has placed on record the status report of the petitioner, which reads as follows: “…this is private complaint filed by the complainant and court endorsed report that occurred on 12.07.2006 at 18.00 hrs at Thotavarı Street, Ramalingeswararaopet, Tenali Town, Guntur and reported on 17.10.2007 at 11.00 hrs in which the complainant Tummalacheruvu Madhavarao S/o.Hanumantharao (late) 67 Yrs, D.No:1-45-8, Mamidabattulavari Street, Nazaepet, Tenali, Guntur stated that the accused 1) Rachakulla Ananda Krishna Kumari @ Krishnakumari W/o Nageswararao, 32 yrs, C/o Machalla Kamalakumari, 3rd lane, Ankamma Nagar, Guntur, (2) Rachakulla Nageswararao, S/o Brahmam, 40 yrs, C/o Machalla Kamalakumari, 3rd lane, Ankamma Nagar, Guntur, (3) Thota Srinivasarao S/o Rosaiah, 37 Yrs, D.No:21- 15-9/5, Thotavari Street, Ramalingeswarapet, Tenalı, Guntur, that the accused taken away cash Rs.4,57,000/- belongs to the complainant with dire consequence and on the intervention of the other they ran away for necessary action. During the Course of the investigation the case was referred as a FALSE on 30.10 2007 It is further submitted that, the complainant Tummalacheruvu Madhva Rao S/o Late Hamunamtha Rao died and no one is available to get his death certificate in his house. His house is in locked condition. Requisition was sent to Municipal office, Tenali for Death Certificate of the Tummalacheruvu Madhavarao, S/o Hanumantharao (late). ….” -4- CRL.R.C. No.427 OF 2009 4. It appears from the record that learned Magistrate, while dealing with the application of the petitioner under Sections 190 and 200 Cr.P.C. for the alleged offence punishable under Sections 420, 379, 448, 323, 506 read with 34 of IPC is of the view that, there are no materials to take cognizance of the complaint on file for the alleged offences. Accordingly, the said complaint was dismissed under Section 203 Cr.P.C. by passing the impugned order. 5. The status report of the Station House Officer, Tenali I Town Police Station suggests that the petitioner has expired. 6. Since the petitioner has passed away, nothing would survive for consideration regarding the legality, correctness, or propriety of the impugned order. Consequently, the criminal revision case is dismissed as infructuous. 7.
