For Petitioner: Mr.R.Gokulnath For Respondent: Mr.S.Yogaraja Sekar Counsel for Government of Tamilnadu (Criminal Side) ORDER The petitioner, who was arrested and remanded to judicial custody on 23.05.2026 for the alleged offences under Sections 331(3) & 305(a) of BNS, 2023 in Crime No.85 of 2026 on the file of the respondent police, seeks bail. 2. The case of the prosecution is that the petitioner committed a theft of 36 sovereigns of gold ornaments and cash of Rs.2,00,000/- from the house of https://www.mhc.tn.gov.in/judis CRL OP No. 19484 of 202 __________ Page2 of 4 the defacto complainant. Hence, the present case 3. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He also submits that the petitioner has been in judicial custody since 23.05.2026 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prays for the grant of bail. 4. The learned Government Advocate (Criminal Side) appearing for the respondent, while opposing the grant of bail to the petitioner, reiterated the prosecution case and, on instructions, submitted that the petitioner has five previous cases registered against him. He further submitted that while 4.5 sovereigns of gold have been recovered so far, the remaining jewelry is yet to be recovered 5. I have given anxious consideration to the submissions made by the learned counsel on either side. 6. Considering the submissions of the learned counsel on either side, the seriousness of the allegations, the petitioner's five previous cases and the fact that while 4.5 sovereigns of gold have been recovered so far, the remaining jewelry is yet to be recovered, this Court is of the firm view that this is not the https://www.mhc.tn.gov.in/judis CRL OP No. 19484 of 202 __________ Page3 of 4 appropriate stage to enlarge the petitioner on bail. 7.
