THE HONOURABLE SRI JUSTICE D RAMESH THE HONOURABLE SRI JUSTICE ALAPATI GIRIDHAR WRIT APPEAL NO: 195/2026
Judgment: (Per Hon’ble Sri Justice D.Ramesh)
The present Writ Appeal is filed aggrieved by the order dated 04.11.2024 passed by the learned Single Judge in W.P. No.24852 of 2024.
2. The said writ petition was disposed of with the following direction:
"Given the facts and circumstances of the case, the writ petition is disposed of at the admission stage, with the consent of both the learned counsel, directing the respondents to conclude the inquiry within a period of three months from the date of receipt of a copy of this order. It is needless to observe that the petitioner shall cooperate with the inquiry. In the event of any delay attributable to the petitioner, the respondents are at liberty to seek extension of time. If the inquiry is not concluded within three months from the date of receipt of a copy of this order, the inquiry proceedings in respect of the charge memos shall stand quashed without reference to any further orders. There shall be no order as to costs."
3. Aggrieved by the aforesaid directions, the present writ appeal has been filed with a delay of 44 days. Learned counsel for the appellants submitted that the learned Single Judge was not justified in directing that the disciplinary proceedings would automatically stand quashed if the inquiry was not concluded within the stipulated period.
4. On a perusal of the record, it is evident that the charge memos pertain to the period from 14.12.2010 to 06.12.2017. Taking into consideration the nature of the charges and the delay in concluding the disciplinary proceedings, the learned Single Judge, instead of quashing the charge memos, directed the respondents to conclude the inquiry within a period of three months, keeping in view the principles laid down by the Hon'ble Supreme Court in a catena of decisions.
5. This Court is not inclined to interfere with the said directions. Moreover, subsequent events reveal that the respondents have already complied with the
order of the learned Single Judge and have concluded the disciplinary proceedings by passing final orders. In view of the subsequent developments, nothing further survives for adjudication in the present writ appeal.
6. Accordingly, the writ appeal is closed. There shall be no order as to costs.
As a sequel, miscellaneous petitions, if any, pending in this writ appeal shall stand closed.
