By this application filed under Section 482 of the BNSS, 2023 the petitioner, namely, Mrs. Dusmita Baruah, has prayed for pre-arrest bail, who apprehends arrest in connection with Lakhimpur P.S. Case No. Page No.# 2/2 11/2026. Perused the Case Diary, so received. Considering the allegations brought against the petitioner and since the petitioner has appeared before the Investigating Officer pursuant to the interim protection granted to her by this Court vide order dated 21.01.2026 and also the fact that the petitioner is a government servant as well as she has been participated in the investigation, this Court is of the opinion that custodial interrogation of the petitioner is not necessary. Hence, the prayer for anticipatory bail made by the petitioner is allowed. Accordingly, the interim order dated 21.01.2026 is made absolute, subject to condition that the petitioner shall continue to appear before the Investigating Officer as and when required, failing which the Investigating Authority will be at liberty to pray before this Court for cancellation of the bail granted to the petitioner.
