“Directing the Respondents to disburse the payments relating to Difference of Gratuity, EL Surrender based on the 12th wage Settlement along with interest and Considering the Petitioner representation dated 20.11.2025 within the stipulated time as may be fixed by this Honble court..”
2. The case of the petitioner is that he joined the respondent Corporation on 22.12.1976 and retired from service on 30.09.2013. The petitioner retired from service on 30.09.2013 prior to the wage settlement entered into under Section 12(3) of the Industrial Disputes Act, 1947, dated 01.04.2015, which was given retrospective effect from 01.09.2013. As per the said settlement, the petitioner is entitled to the difference in EL surrender and gratuity. However, the said benefits have not been extended to the petitioner. In this regard, the petitioner submitted several representations to the respondent. As the same were not considered, the petitioner has filed the present Writ Petition. 3. The learned Standing Counsel for the respondents 1 and 2 would fairly submit that they are willing to pay the applicable and eligible differential amount of EL surrender and gratuity in accordance with the 12(3) Wage Settlement dated 01.04.2015 together with interest at the rate of 6% per annum. https://www.mhc.tn.gov.in/judis

4. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing on behalf of the respondents 1 and 2. 5.
In view of the above submission of the learned Standing Counsel appearing on behalf of the respondents 1 and 2, this Court deems it appropriate to direct the respondents to pay the eligible and applicable differential amount of EL surrender and gratuity to the petitioner, in accordance with the 12(3) Wage Settlement dated 01.04.2014, together with interest at the rate of 6% per annum from the date on which the amounts became due till the date of actual payment. This payment shall be made within a period of six (6) weeks from the date of receipt of a copy of this order. No costs. 6. Accordingly, the Writ Petition is disposed of.
