Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of mandamus declaring the Actions of the 2nd respondent in issuing the proceedings vide RC no. 31-A3/2021 dated 06.01.2022 and further issuance of show cause notice vide Rc.no.15-A/2021 dated 28.01.2022 by the 3rd respondent is as illegal,
2 arbitrary, violation of principles of natural justice and violative of article 14, 21 of the Constitution of India and contrary to the AP State subordinate service rules and consequently set aside the above said proceedings.

ORDER:-
The notices vide Rc.No.31-A3/2021 dated 06.01.2022 and Rc.No.15-A/2021 dated 28.01.2022 are assailed in the present Writ Petition on the ground that the said notices are contrary to Rule 26(d) of the A.P. State and Subordinate Services Rules.

Learned counsel appearing for the respondents would submit that the seniority list was published in the year 2013 and later it was re-published in the year 2020 and in the seniority list prepared in the year 2013, the petitioner was at serial No.26 and in the subsequent seniority list prepared in the year 2020, the petitioner was placed at serial No.3. The said seniority list is prepared basing upon the age, which is unknown to law and the seniority list has to be prepared basing upon the date of joining into the post and on merit.
3. However, the petitioner herein submitted his explanation to the aforesaid notices through e-mail dated 09.02.2022. Both the learned counsel for the petitioner and the respondents have agreed for disposal of the Writ Petition without going into the merits of the case let the authorities conduct an enquiry after affording a personal hearing to
4 all the affected parties including the petitioner and the respondents and to conclude the said enquiry in accordance with law.

Agreeing for the aforesaid submission, the present Writ Petition is disposed of directing the 3rd respondent to conduct an enquiry after affecting notices to both the petitioner and the respondents and after giving an opportunity of hearing and conclude the said enquiry in accordance with law. It is needless to say that the said enquiry should be completed within a period of three months from the date of receipt of a copy of this order. Till such time, the respondents are directed not to revert back the petitioner to the post of Office Subordinate. The petitioner is permitted to raise all the grounds before the respondent authorities which are raised before this Court in the present Writ Petition. There shall be no order as to costs.
As a sequel thereto, interlocutory applications pending if any, shall stand closed.
