“Directing the Respondents to disburse the payments relating to Difference amount of Gratuity, EL Surrender, Arrears of salary while in Service and pension Arrears as per 12 (3) Wage Settlement and Considering the petitioner representation dated 12.04.2017and 04.06.2018 within the stipulated time as may be fixed by this Honble court..”
2. The case of the petitioner is that he joined the respondent Corporation on 13.02.1978 and retired from service on 31.10.2014. The petitioner retired from service on 31.10.2014 prior to the wage settlement entered into under Section 12(3) of the Industrial Disputes Act, 1947, dated 01.04.2015, which was given retrospective effect from 01.09.2013. As per the said settlement, the petitioner is entitled to the difference in EL surrender, gratuity, arrears of salary from 01.09.2013 to 31.10.2014 and pension arrears. However, the said benefits have not been extended to the petitioner. In this regard, the petitioner submitted several representations to the respondent. As the same were not considered, the petitioner has filed the present Writ Petition. 3.

WP No. 28394 of 2026 __________ Page3 of 4 amount of EL surrender, gratuity, arrears of salary from 01.09.2013 to 31.10.2014 and pension arrears in accordance with the 12(3) Wage Settlement dated 01.04.2015 together with interest at the rate of 6% per annum. 4. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing on behalf of the respondents 1 and 2. 5. In view of the above submission of the learned Standing Counsel appearing on behalf of the respondents 1 and 2, this Court deems it appropriate to direct the respondents to pay the eligible and applicable differential amount of EL surrender, gratuity, arrears of salary from 01.09.2013 to 31.10.2014 and pension arrears to the petitioner, in accordance with the 12(3) Wage Settlement dated 01.04.2014, together with interest at the rate of 6% per annum from the date on which the amounts became due till the date of actual payment. This payment shall be made within a period of six (6) weeks from the date of receipt of a copy of this order. No costs. 6. Accordingly, the Writ Petition is disposed of.
