2. The case of the prosecution is that on 19.10.2022, when the de facto complainant was alone at her residence, the 1st petitioner committed sexual assault on her assuring that he would marry her. It is further alleged that he continued to have physical relationship with the defacto complainant for several occasions. Later, he refused to marry her. Hence, the case.
3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any offence as alleged by the de facto complainant and they have been falsely implicated in this case. He further submitted that they are ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that 1st petitioner, under false promise, had physical relationship with the victim and later, refused to marry her. Hence, she opposed to grant anticipatory bail to the petitioners.
5. I have given my anxious consideration to either side submissions and perused the materials available on record. https://www.mhc.tn.gov.in/judis

6. Considering the facts and circumstances of the case, taking note of the
submissions made by learned counsel on either side, the allegation against the petitioners is that under the false promise, the 1st petitioner had physical relationship with the defacto complainant/victim. Later, he refused to marry her in spite of having a betrothal. At this juncture, the learned counsel for the petitioner submitted that the occurrence took place in the year 2022 whereas the complaint came to be registered in the year 2026. While looking into the factual position, the physical relationship between the 1st petitioner and the defacto complainant was consensual in nature and the petitioners 2 to 4 are relatives to first petitioner. In such view of the circumstances, this Court is of the firm view that the custodial interrogation of the petitioners are not required. Hence, this Court is inclined to grant anticipatory bail to the petitioners, subject to certain conditions. 7. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen (15) days from the date on which the order copy is made ready, before the learned Judicial Magistrate, Tiruvannamalai on condition that the petitioners shall execute a separate bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties each, for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions: (a) If the petitioners fails to surrender before the concerned https://www.mhc.tn.gov.in/judis
