ORDER The petitioner, who was arrested and remanded to judicial custody on 14.06.2026 for the alleged offences under Sections 126(2), 296(b), 115(2), 311 and 351(3) of the Bharatiya Nyaya Sanhita, 2023, in Crime No.328 of 2026 on the file of the respondent police, seeks bail. 1/4 https://www.mhc.tn.gov.in/judis

2. It is the case of the prosecution that the petitioner waylaid the defacto complainant, robbed him of a sum of Rs.400/-, and threatened him with dire consequences. Hence, the case.
3. The learned counsel for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case. He would further submit that the petitioner has been in custody since 14.06.2026 and is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for the grant of bail.
4. The learned Government Advocate (Crl. Side) appearing for the respondent, while opposing the grant of bail to the petitioner, reiterated the prosecution case and, on instructions, submitted that the petitioner has 19 previous cases to his credit, including one murder case.
5. Considering his criminal antecedents, particularly the involvement in a murder case, and having regard to the nature of the allegations as well as the
submissions made by the learned Government Advocate (Crl. Side), this Court is of the view that it would not be appropriate to grant bail to the petitioner at this stage. 2/4 https://www.mhc.tn.gov.in/judis
