(Oral) This writ petition has been filed by petitioner seeking a writ of mandamus directing respondent nos.1 to 6 to remove the illegal encroachment made by respondent no.7 from Government/public land, take possession of the encroached land, and restore it as public land (in the prayer clause, the respondents have been wrongly transcribed by the petitioner inadvertently). 2. Learned counsel for the petitioner submits that private respondent no.7 has encroached upon the public road at Mohalla Teliyan, Nai Basti, Jwalapur, Tehsil and District Haridwar. 3. It is contended by learned counsel for respondent-Nagar Nigam and HRDA that, upon inspection, it was found that encroachment had been made by private respondent no.7 on the public road. Notices were issued by respondent-Nagar Nigam to respondent no. 7, but despite the notice, he did not remove the encroachment. The Nagar Nigam is 2026:UHC:3733 2 proceeding against respondent no.7 in accordance with law. 4. In view of the submissions made by learned counsel for respondent nos. 2, 3, 5 & 6, this writ petition is finally disposed of with a direction to respondent nos. 1 to 6 to ensure that the encroachment, if any, made by respondent no.7 on the public road is removed in accordance with law, after hearing respondent no.7, within a period of one month from the date of production of a certified copy of this order. 5.
