Present bail application is moved by the applicant, who is in judicial custody in connection with FIR/Case Crime No.734 of 2025 under Section 64(2)(m), 65(1) of the Bhartiya Nyaya Sanhita (BNS) and Section 3(a)/4(2), 5(j)(ii)(1)/6 of the Protection of Children from Sexual Offences Act, Police Station Kotwali Haridwar, District Haridwar. 4. Learned counsel for the applicant submits that applicant has been falsely implicated in the present case; no date time or place of the alleged incident has been given in the FIR. He submits that as per the statement given by the victim she has categorically deviated from her statement under Section 183 BNSS as given earlier and in her cross examination she has clearly deleted the role of the applicant/accused that he committed any sexual offence against her. He further submits that she is not aware that who the applicant accused is and she never ever saw him. Deviating her statement she submits in her cross examination that the person who committed sexual offence against her could not identified due to dark hours and resulting that incident she got pregnant and again she deviated from her earlier statements and denied any such statement she ever gave to the police or to the Magistrate. 5. Learned State counsel vehemently opposed the bail application. 6. Having heard learned counsel for the parties and considering the overall facts and circumstances of the case, this Court is of the view that applicant is entitled to be released on bail. 7. Accordingly, bail application is allowed. Let the applicant-Ujjawal Pal be released on bail on his executing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned. 8.
