No.13982 of 2026 Sections 132, 281 & 109(1) of BNS Act, 2023, r/w Section 21(1) of the Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.318 of 2026, on the file of the respondent police seeks anticipatory bail. 2. The allegation against the petitioner is that on 10.06.2026 the petitioner was involved in illegally quarrying and taking sand. When the respondent police tried to intervene and stop this petitioner, the petitioner left the back-storing area of the tipper and dropped the sand on the road and also attempted to drop the sand on the officers and thereafter drove the vehicles out to some distance, parked them, and ran away from there. Hence, the case has been registered. 3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that since the petitioner's belongings were found in the lorry, he has been arrayed as an accused in this case and he is not involved in this case and he is ready to co-operate with the investigation. 2/5 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.13982 of 2026 Hence, he prayed to grant anticipatory bail to the petitioner. 4. The learned Counsel For State of TN (Crl.Side) appearing for the respondent police, reiterated the prosecution case, and on instructions, reported that it is a case of not only illegal quarrying sand but also attempted to murder the officers and also block the road. Hence, the case has been registered. However, the petitioner is absconding and the investigation is at preliminary stage. Hence, he opposed to grant anticipatory bail to the petitioner. 5. I have gone through the FIR and also the connected materials. 6.Considering the nature of allegations against the petitioner, and also considering the fact that since the petitioner is absconding and the investigation is at preliminary stage, granting anticipatory bail would hamper the investigation.
