ORDER This Writ Petition is filed seeking to Writ of Mandamus directing the 1st and 2nd respondents to take action on the complaint seeking to stop the illegal operations of the amusement rides and activities being conducted without proper permission and safety measures in Survey nos. 224, 225, 230 and 231, Ward B Sankarankovil Part-2, Sankarankovil Town, Tenkasi District. 2/6 https://www.mhc.tn.gov.in/judis

2. The learned counsel for the petitioner submitted that in the eve of Aadi Thabasu Festival in a poramboke land, which is situated without proper access and in a congested area, illegal operations of amusement rides and activities are being conducted without proper permission in Survey Nos.224, 225, 230 and 231 of Ward B, Sankarankovil Part-2, Sankarankovil Town, Tenkasi District and further submitted that the same should be immediately stalled since the same may endanger the common public who go for amusement ride and participate in the other games, which is to be organized there.

However, the Learned Government Advocate, submitted that the very same ground has been used for the past 20 years during the Audi Thabasu Festival by the common public and as far as this year is concerned, already the Revenue Division Officer, Sankarankovil had by proceedings in REVSKL/1541/2025 - A1 dated 08.07.2025 had imposed as many as 11 strict conditions for the organization, which was duly complied by the organizers. Even this year, the District Collector by proceedings in Na.Ka.No.157/Se.Ma.Tho.A/2026 dated 07.07.2026 had 3/6 https://www.mhc.tn.gov.in/judis
WP CRL.(MD). No.3967 of 2026 imposed several conditions for the organizers to follow with, and the same will be strictly monitored by the respondent police as well.
4. The Learned Government advocate appearing for the third repsondent submitted that the survey numbers, as pointed out by the
learned counsel for the petitioner, has no relevance with the survey numbers, where the organizers have sought permission and no objection from the various departments, to conduct the aforesaid festival and amusement park. They said already the Tamil Nadu Fire and Rescue Services Authority had inspected the site located at Survey No.450/A, Sankarankovil Village, Sankarankovi Taluk, Tenkasi, on 08.06.2026 and had approved the proposal to conduct amusement activities on the eve of Aadi thabasu from 17-7-2026 to 17-8-2026. The writ petitioner has come before this court with a mischievous intention only to disturb the peaceful conduct of the festival and sought the dismissal of the writ petition.

6. Aadi Thabasu is a very important traditional festival which is being conducted from time to time by the people of Tamil Nadu with great bhakti and devotion. Writ petition like this, would harm the communal harmony and religious harmony of the locality and this Court negates all the claim of the petitioner on the basis of the proper instructions and various permissions which has been already afforded to the organizers by the Government. All the permissions as granted by the Government and the steps taken by the District Collector and the respondent police have also been brought on record. The Sankarankovil Municipality has also taken all necessary steps to ensure peaceful conduct of the festival.
