C.M.P.(MD)No.6307 of 2026 in C.M.A(MD)SR.No.17768 of 2026 K.MURALI SHANKAR,J. The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 25 days in filing appeal, challenging the award, dated 10.10.2025 made in M.C.O.P.No.232 of 2019 on the file of the Motor Accident Claims Tribunal cum Chief Judicial Magistrate, Nagercoil. 2.The learned counsel appearing for the petitioner would submit that the third respondent is the owner of the vehicle. Since no claim has been made against him, issuance of notice to the third respondent is not necessary, and his presence is not required. He has also filed a memo to that effect. 3. The said memo is recorded. Heard the learned counsel for the petitioner as well as the learned counsel for the respondents 1 and 2 and also perused the records. 4.Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered. Registry is directed to take the appeal on file, if it is otherwise in order and list the matter in the regular course. 23.07.2026 das https://www.mhc.tn.gov.in/judis
