The petitioners are apprehending their arrest in connection with Garhwa P.S. Case No.257 of 2025, for offence registered under section 126(2), 115(2), 118(1), 118(2), 109(1) and 3(5) of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Garhwa. 3. Learned counsel for petitioners submits that the petitioners were attending the marriage party, wherein the alleged occurrence is said to be occurred. He next submits that the allegation against the petitioners are there of assault to Nepal Paswan, however, Nepal Paswan has not received injury and the injury was found on the body of Birendra Bind and the petitioners have got no criminal 2026:JHHC:1429 2 antecedent as disclosed in paragraph no.13 of the petition. 4. Learned State counsel opposes prayer and submits that grievous injury has been found upon said Birendra Bind. 5. Looking to the contents of the FIR it transpires that allegation of assault is made against the petitioners upon Nepal Paswan however the injury is said to be on Birendra Bind and the petitioners have got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioners. 6. Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Garhwa, in connection with Garhwa P.S.
