GP FOR HOUSING The Court made the following: 4 Order:- The learned counsel for the petitioner submits that the petitioner has completed the works entrusted by the District Collector, namely: (i) Layout development with formation of gravel roads (approach roads and three cross roads) and providing RCC survey poles for demarcation of plots to the house sites at Baligattam in Survey No.693 of Narsipatnam Municipality under the YSR Gruha Vasathi Scheme, vide M-Book No.87/19-20, dated 10.02.2021, and (ii) Layout development with formation of approach roads to the house sites layouts at Baligattam in Survey No.693 of Narsipatnam Municipality under the YSR Gruha Vasathi Scheme, vide M-Book No.83/19-20, dated 10.02.2021. 2. Learned counsel appearing for the 9th respondent has filed a counter and, in paragraph No.6 thereof, it is stated as follows:- 6. It is respectfully submitted that the works mentioned in the Writ Affidavit are relating to the YSR Gruha Vasathi scheme which is a government initiative for providing certain amenities for weaker section housing layout colonies taken up during the year 2020 and 2021. The YSR Gruhavasathi funds are under the administrative control of District Collector and the administrative sanction for taking up the works under this scheme shall be sanctioned by the District Collector including release of funds under the relevant head of account relating to YSR Gruha Vasathi scheme. It is submitted that the petitioner also admitted the fact of the same that these works sanctioned under the same YSR Gruha Vasathi scheme. 5 3. The learned Standing Counsel appearing for the 4th respondent submits that the bills are not payable by the 4th respondent and that it is the 6th respondent who is the sanctioning authority under the Government scheme and, therefore, the competent authority to sanction and release the payments. 4. The learned counsel for the petitioner submits that the M-Books filed by the petitioner would indicate that the works have been completed in all respects and that the payments are due and payable. It is submitted that the District Collector/6th respondent, being the competent authority, shall release the payments due and payable to the petitioner. 5. Recording the submissions, this writ petition is disposed of at the admission stage, directing the concerned respondents to verify and release the payments due and payable to the petitioner, if not already released, as expeditiously as possible, preferably within a period of six (06) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
