No.15178 of 2026 judicial custody on 03.07.2026 for the offences punishable under Sections126(2), 309(4), 311 & 351(3) of BNS, in Crime No.300 of 2026 on the file of the respondent police, seek bail. 2. The case of the prosecution is that the petitioners joined hands with another accused involved in waylaying the defacto complainant and robbed a sum of Rs.2500/- from his pocket. Hence, the case has been registered, and the petitioner was arrested on 03.07.2026. 3. The learned counsel appearing for the petitioners would submit that the petitioners are innocent and they have been falsely implicated in this case since they are having some previous antecedents and only for statistical purposes, this case has been foisted against them and they are in custody from 03.07.2026 onwards. Therefore, prayed to grant bail for the petitioners. 4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and on instructions, reported 2/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.15178 of 2026 that the first petitioner is having 9 previous cases and the second petitioner is having 5 previous cases and sicne both are having bad antecedent, if they released on bail, they will indulge in similar kind of offence and hence, opposed to grant bail to the petitioners. However, submitted that the amount was recovered. 5. I have gone through the FIR and also the connected materials. 6. Though it is stated that the petitioners are having previous cases, fairly conceded the allegations made against the petitioners in the FIR and other circumstances, and also considering the period of incarceration undergone by the petitioners, this Court is inclined to grant bail to the petitioners subject to the following conditions: [a] Accordingly, the petitioners are ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.5, Trichy, and on further conditions that: 3/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.15178 of 2026 [b] the petitioners shall stay at Salem and report before the Judicial Magistrate No.3, daily at 10.30 a.m., for a period of 2 weeks and thereafter as and when required for interrogation. [c] the petitioners shall not commit any offence similar to the offence of which they are accused, or suspected, or of the commission of which they are suspected; [d] the petitioners shall not abscond either during investigation or trial; [e] the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or to any police officer or tamper with the evidence; [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself 4/6 https://www.mhc.tn.gov.in/judis CRL OP(MD).
