For Respondent : Mr.D.Rajaboopathy - for R1 and R2 Government Advocate (Crl.Side) ORDER This Writ Petition is filed seeking to issue a Writ of Mandamus directing the respondents more particularly the second respondent to consider the petitioner's representation dated 29.06.2026 and consequently direct the second respondent to initiate criminal action as per the complaint of the petitioner forthwith. 2. The learned council for the petitioner submitted that the petitioner is doing a business of manpower consultancy in the name and style of HD consultancy, for the past more than 10 years. One JeyaKumar, ie., the third respondent herein, had approached her for arranging student visa, which was dealt with by the petitioner and a 'Letter of Interest' was also obtained by her from the University of Russia. For the processing of student visa and other related paperworks the petitioner had received a sum of Rs.5,50,000/-. He had also signed an 2/6 https://www.mhc.tn.gov.in/judis WP CRL.(MD). No.3933 of 2026 undertaking affidavit as a proof of receipt of the amount and had also received a copy of his passport, Course certificates and mark sheets and commenced the work for visa process. On 23-3-2026, she received the student visa for the said Jeyakumar and reported the same to him and insisted him to get ready for joining his educational venture abroad at Russia. However, they said Jeyakumar, having refused to receive the same, demanded the return of service charges paid to her. The petitioner had informed him that the visa can not be cancelled and the service charges which was detected from him cannot be refunded since she had already fulfilled her duty as a manpower consultancy. Thereafter, the said Jeyakumar had continuously indulged in inappropriate criminal action, hindering the petitioner's business, and creating ruckus in her place of business, forcing her to close the business. In this regard, she has sustained huge loss personally and monetarily, for which she had lodged a complaint before the respondent police. The respondent police, without dealing with her complaint sensibly, had closed the same, and hence sought the indulgence of this Court. 3/6 https://www.mhc.tn.gov.in/judis WP CRL.(MD). No.3933 of 2026 3. The Government Advocate submitted recording to the non- appearance and non-cooperation of the petitioner for investigation, the same was closed. It is brought to the notice of this Court by the learned Government Advocate that already a first information report in Crime No. 76 of 2026 dated 25.03.2026 has been registered by the second respondent police in a matter where the petitioner had defrauded one Yogaraj, who was similarly victimized by the same petitioner, at his instance the above case was registered against the petitioner as there are professional lapses on the petitioner's end. As far as this matter is concerned, the matter is already closed. 4. Per contra, the learned counsel for the petitioner submitted that the respondent police, instead of handling the case sensibly, is threatening the petitioner to return the service charges as received by her from Jeyakumar. 5. The Assistant Commissioner of Police, Madurai, is suo motu impleaded as fourth respondent. Registry is directed to carry out necessary amendment in the cause title. 7. In view of the above submission, the second respondent police is directed reopen the petitioner's complaint, put the petitioner as well as the third respondent on notice under Section 64 BNSS, conduct an enquiry and conclude the enquiry within a period of four weeks from the date of receipt of a copy of this order. The fourth respondent is directed to monitor the investigation to be conducted by the second respondent and the second respondent is directed to appraise the progress of the investigation to the fourth respondent on every Friday. 8.
