With the consent of both sides, this writ petition is disposed of at the admission stage. 3. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondent – Transport Corporation. 4. This writ petition has been filed challenging the proceedings bearing No.O.Na.Thu/D1/Usilai/DR/3933, dated 31.12.2025, issued by the second respondent, whereby the petitioner was inflicted with a punishment of stoppage of increment for a period of two years with cumulative effect on the alleged misconduct of causing an accident resulting in a death of a person. ____________ https://www.mhc.tn.gov.in/judis W.P.(MD) No.20661 of 2026 5. At the threshold, Mr.S.Gladson Michael Rajadurai, learned Standing Counsel, appearing for the respondent – Transport Corporation, on instructions, submitted that the petitioner has got an efficacious alternative remedy of appeal before the Managing Director / first respondent herein as against the impugned proceedings issued by the second respondent and the petitioner, instead of availing the said appeal remedy, has straightaway approached this Court by filing the present writ petition. 6. However, learned counsel for the petitioner submitted that the impugned proceedings dated 31.12.2025 has not been served on the petitioner as on date and therefore, the petitioner could not avail the said appeal remedy within the time limit prescribed under the relevant Regulations. 7. Considering the fact that the petitioner has got an efficacious alternative remedy of appeal before the Managing Director / first respondent herein as against the impugned proceedings issued by the second respondent and also the contention of the learned counsel for the petitioner that the impugned proceedings has not been served on the petitioner till date, this Court is of the considered view that it is a fit case, where the petitioner shall be permitted to avail the alternative remedy of appeal before the Managing ____________ https://www.mhc.tn.gov.in/judis W.P.(MD) No.20661 of 2026 Director / first respondent herein within a period of four weeks and then to direct the Managing Director / first respondent herein to consider the said appeal in accordance with law. 8. Accordingly, this writ petition is disposed of permitting the petitioner to avail the alternative remedy of appeal before the Managing Director / first respondent herein as against the impugned proceedings bearing No.O.Na.Thu/D1/Usilai/DR/3933, dated 31.12.2025, issued by the second respondent, within a period of four weeks from the date of receipt of a copy of this order and on filing such appeal by the petitioner, the Managing Director / first respondent herein shall consider the same on merits without reference to the limitation and pass appropriate orders thereon in accordance with law, as expeditiously as possible, at any rate, within a period of two months from the date of filing the appeal by the petitioner. No costs.
