Das for the petitioner Saddam Hussain who has filed this application under Section 483 of the BNSS, 2023 with a prayer for bail as he is behind bars since 16.08.2024 in connection with Sessions Case No. 343/2024 arising out of Dhubri PS Case No. 282/2024 under Sections 126(2)/109(1) of the BNS. Page No.# 2/2 2. Charges were framed vide order dated 12.11.2024 under Sections 118(1)/118(2)/109(1) of the BNS. It is submitted that out of 8 witnesses 7 witnesses have already been examined. After considering the submissions of both the sides, the petitioner was granted interim bail. This Court has called for scanned copies of the notices under Section 47 and 48 of the BNSS as it was submitted on behalf of the petitioner that grounds of arrests were not clearly mentioned while issuing notice under section 47 of the BNSS as well as notice under section 48 of the BNSS. 3. I have also scrutinized the scanned copies of the notices issued to the family members and acquaintance of the petitioner under Section 47 and 48 respectively. I have also considered that the petitioner is willing to cooperate with the remaining part of the trial. It is submitted that the petitioner being a local resident is not a flight risk. 4. In view of the foregoing discussions, the interim order dated 06.04.2026 is hereby made absolute under the same terms and conditions. 5. The bail application stands disposed of.
