For Respondent : Mr.J.Vishnu, Government Advocate (Crl.Side) ORDER The petitioner apprehends arrest for the alleged offence under Section 305(a) of BNS Act, 2023, @ 380 of IPC in Crime No.889 of 2025, on the file of the respondent police seeks anticipatory bail. 2. No.13975 of 2026 entered into the house of the defacto complainant and took away a two- wheeler and various documents such as an Aadhaar card, ATM card, two bank cheque books, cash amount of Rs.30,000/-, etc. Hence, the case has been registered. 3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that there is a delay in lodging the FIR and he is ready to deposit a sum of Rs.30,000/- and also ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner. 4. The learned Counsel For State of TN (Crl.Side) appearing for the respondent police, reiterated the prosecution case, and on instructions, reported that the petitioner is having 10 previous cases similar in nature and if the petitioner is released on anticipatory bail, there is no possibility of recovery of property and the investigation is at preliminary stage. I have gone through the FIR and also the connected materials. 6.Considering the various documents and also considering the facts that the petitioner has previous case similar in nature and stolen properties have not yet been recovered and the investigation is at preliminary stage, granting anticipatory bail would hamper the investigation.
