ORDER The present petition has been filed by accused Nos. 2 & 3 in S.T.C.No. 71 of 2026 on the file of the Judicial Magistrate, Natham, Dindigul District seeking to quash the F.I.R wherein they are charged with the offence under Section 295 of I.P.C. 2.A perusal of the charge sheet reveals that the petitioners are said to have desecrated the idols and a complaint has been lodged by the defacto complainant. The defacto complainant has appeared and filed an affidavit in which paragraph Nos.3 and 4 are extracted as follows:
“3.I further submit that, only subsequently, I came to know that the present petitioners, namely Accused Nos.2 and 3, who are none other than my close relatives, had also been implicated in the present case. I respectfully state that they were never suspected by me at any point of time. I have now learnt that their implication is stated to be solely on the basis of the alleged confession said to have been given by the accused No.1 during investigation. Except such alleged confession, I am not aware of any independent material connecting the petitioners with the alleged occurrence. 4.I respectfully submit that the alleged confession attributed to accused No.1 appears to have been made only with an oblique motive to falsely implicate my relatives and thereby exert pressure upon my family to compromise and withdraw the complaint lodged against him. unnecessarily been dragged into the criminal prosecution. They have no direct involvement whatsoever in the alleged incident.” 3.According to the learned counsel appearing for the defacto complainant, he had lodged a complaint only as against accused No.1.
A1 has wantonly implicated accused Nos. 2 and 3. According to him, accused Nos.2 and 3 belong to his village. There is no reason for them to desecrate the idols. The learned counsel had further submitted that he has never made any complaint as against accused Nos.2 and 3 and they have been falsely implicated. 4.In view of the above said facts, the charge sheet in S.T.C.No.71 of 2026 on the file of the Judicial Magistrate, Natham, Dindigul District stands quashed as against the petitioners herein. This Criminal Original Petition stands allowed. Consequently, connected miscellaneous petition is closed. 21.07.2026.
