This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.131/2025 registered at Police Station - Gidhpuri, District - Balodabazar Bhatapara (C.G.), for the offences punishable under Section 109 & 3(5) of the BNS. The prosecution story, in brief, is that on 17.10.2025 at about 9:00-10:00 PM at Durga Chowk, Datrengi, the complainant was with his friend Gopi Chakradhari, just then Gopi Chakradhari and co-accused (Jitesh Chakradhari) of the same village has an argument over speeding of the bike and the two started fighting. When the complainant tried to intervene co-accused (Jitesh Chakradhari) and his other friend attacked him fatally, injuring him in the back with a knife and while he was trying to save himself, they attacked him on the head.

Learned counsel for the applicant submits that the applicant is an innocent person and has been falsely implicated in this offence. It is further submitted that It is submitted that the applicant was arrested by the police under the aforesaid offence without proper investigation, as the alleged liquor was seized from a vehicle (Activa) which does not belong to the applicant. It is further submitted that the learned Court below failed to appreciate that only one previous case was registered against the applicant, in which he has already been acquitted vide order dated 28.07.2025, and presently he is not involved in any criminal activity. The applicant is a 19-year-old young boy and the sole bread earner of his family and is also responsible for taking care of his aged parents. The applicant is in judicial custody since 27.12.2025 and the investigation in the present crime has already been completed and the charge-sheet has been filed on 28.01.2026 before the learned Chief Judicial Magistrate. In these
3 circumstances, as the applicant has a good case on merits and the trial is likely to take considerable time, it is prayed that he be enlarged on regular bail. 4. On the other hand, learned State Counsel has vehemently opposed the anticipatory bail application and submitted that the present applicant is the main assailant who inflicted injuries upon the victim. It is contended that, as a consequence of the assault, the injured sustained grievous injuries, specifically an incised wound over the lower border of the left scapula measuring 10×2×1.5 cm and another incised wound over the left parietal region measuring 1×0.5×0.2 cm, which clearly indicate the use of a sharp-edged weapon., therefore, the applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6.
Considering the facts and circumstances of the case, the nature and gravity of the alleged offence, as well as the material available on record, the MLC report clearly shows that the injured has sustained grievous injuries, namely an incised wound over the lower border of the left scapula measuring 10×2×1.5 cm and another incised wound over the left parietal region measuring 1×0.5×0.2 cm, which indicate the use of a sharp-edged weapon and are opined to be dangerous to life, therefore, in view of the grievous and life-threatening nature of the injuries, the manner in
4 which the offence is alleged to have been committed, and the overall facts and circumstances of the case, this Court is of the opinion that granting bail to the applicant at this stage would not be appropriate, and accordingly, the bail application filed by the applicant is hereby rejected. 7. Accordingly, the anticipatory bail application of the applicant – Dinesh @ Rinku Dhruw, involved in Crime No. 131/2025 registered at Police Station - Gidhpuri, District - Balodabazar Bhatapara (C.G.), for the offences punishable under Section 109 & 3(5) of the BNS, is rejected.
