CRL OP(MD). No.13976 of 2026 Sections 303(2) of BNS Act, 2023, and Section 4(1)(1A) and 21(1) of Mines & Minerals (Development & Regulation) Act, 1957, in Crime No. 296 of 2026, on the file of the respondent police seek anticipatory bail.
2. The allegation against the petitioners is that on 03.07.2026 at about 04.00 a.,m, he illegally quarried river sand in Marichikatti Odai in a tractor. Hence, the case has been registered.
3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any such offence as alleged by the prosecution and they have been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioners.
4. The learned Counsel For State of TN (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that investigation in this case is still pending. However, he oppose to grant anticipatory bail to the petitioners.
5. Considering the above facts and circumstances of the case, the petitioners have illegally quarried sand from Marichikatti Odai and also 2/4 https://www.mhc.tn.gov.in/judis
CRL OP(MD). No.13976 of 2026 caused damage to the ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioners.
