[2026:RJ-JP:12733] (2 of 5) [CRLMB-4499/2026] required in investigation. He further submits that there are no chance of fleeing of applicants accused from the jurisdiction of this Hon’ble Court. He also submits that the applicants undertake not to repeat offence and cooperate with investigation/trial, which will take time. 3. He submitted that both of them have not supported the case of prosecution. He also submitted that as per the prosecution’s story, unknown assailants have fired upon Shambhu Singh and due to this fire, Shambhu Singh died, but there is no evidence to connect both the petitioners with the alleged incident. He also submitted that in the FIR Deepak Meher was named as one of the eyewitness and Deepak Meher has turned hostile and not supported the case of prosecution. He also referred to the cross-examination of PW-4 Deepak Meher and submitted that Deepak Meher has denied witnessing the incident. He further referred to the order dated 17-03-2026 in bail application number 16086/ 2025 in respect of Farooq Khan and submitted that a co-ordinate bench has granted bail to Farooq Khan and the case of both these petitioners is on better footings than Farooq Khan. At last, he submitted that both the accused are in custody since their arrest on 09.05.2025 and 04-05-2025 respectively. 4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the allegations are grave and
[2026:RJ-JP:12733] (3 of 5) [CRLMB-4499/2026] serious in nature. He further submitted that both the petitioners are involved. 5. Heard learned counsel for the petitioner-accused and learned Public Prosecutor. Perused the material placed on record by both the parties. 6. This court has considered first bail application of both the petitioners on 25-08-2025 and while dismissing the bail application, we have observed the facts as under:
"On basis of a complaint lodged by complainant Kishan Singh on 25.04.2025 about assault and murder of his brother Shambu Singh in the evening of 24.04.2025, a criminal case is registered and investigated.
During investigation, police has recorded statement of eye-witness Deepak and Ishwar Singh and detained a juvenile on 28.04.2025 and after investigation filed a charge-sheet against him. The police has found involvement of Sohail @ Sohail Lala, Faizal @ Hidayat Khan in the incident. During investigation, police has found that Sohail @ Sohail Lala has procured firearm from Shoaib @ Bhuriya who assisted him after the incident. The police has also found involvement of Munna Mansuri and filed a charge- sheet under Section 5/25 of Arms Act against him. The post-mortem report indicate that due to firearm injury Shambhu Singh has expired whereas Deepak has suggested that four persons were sitting and in vehicle No. RJ-17-CB-7107. As per statement of Ishwar Singh, recorded under Section 183 of BNSS Sohail has fired the deadly shot upon deceased. The allegation on present applicant Munna Mansuri is that he sold 3 pistols and 8 live cartridges to Shoaib @ Bhuriya and his information under Section 23(2) of BSA is recorded by police. [2026:RJ-JP:12733] (4 of 5) [CRLMB-4499/2026] Though, the allegation upon both the applicants is not for involvement in the incident but it is a case relating to murder of an individual and there is one criminal case besides one against Shoaib @ Bhuriya and 4 criminal cases is reported against Munna Mansuri @ Naved whereas 3 of them are related to Arms Act. Thus, before recording the statement of eye- witness Deepak and Ishwar Singh, it is not appropriate to consider bail application of both the applicants- accused."
7. A Co-ordinate bench has granted bail to Farooq Khan and we have considered the order passed by the co-ordinate bench. While forwarding the charge sheet, police found that Shoaib @ Bhuriya has committed offence under section 249 of BNS and 5/25 of Arms Act, whereas Munna Mansuri @ Naved has committed offense under section 5/25 of Arms Act.
As per charge sheet, accused Shoaib @ Bhuriya was named for harbouring the offender, and police has also not named Shoaib @ Bhuriya and Munna Mansuri @ Naved as the person involved in the incident of murder. 8. Upon hearing the arguments and perusing the record, we have found that the applicants-accused are no more required in the investigation and they are in custody for quite some time. The further proceedings will take its own time, therefore, looking to entirety of facts and circumstances of the case and without expressing any opinion on merits of the case, the Court deems it appropriate to grant bail to the applicants-accused. 9. Thus, the second bail application filed on behalf of applicants-accused Munna Mansuri @ Naved S/o Shafi
[2026:RJ-JP:12733] (5 of 5) [CRLMB-4499/2026] Mohammed and Shoaib @ Bhuriya S/o Jalal Khan, is hereby allowed and the applicants-accused are ordered to be released on bail upon furnishing a personal bond of ₹50,000/- by each of the petitioner with two sureties of like amount to the satisfaction of the Trial Court with the following conditions:- (i) The applicants-accused shall not tamper with
