ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.184 of 2024 of Vinukonda Police Station, Palnadu District, registered against the Petitioner/Accused No.1 herein for the offences punishable under Sections 103(1) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS).
2. Smt. Marella Radha, the learned Legal Aid Counsel for the Petitioner, submits that the Petitioner is innocent of the alleged offence and he has been falsely implicated in the alleged offence. He has not committed any offence. He is law-abiding citizen. He has got fixed abode. The Petitioner undertakes to abide by any conditions that this Court may impose while granting bail to the Petitioner. Therefore, she prays that the present petition be allowed.

Per contra, Mr.A.Rohit, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the petitioner and submitted that though the charge sheet has already been filed in the case, the accusations against the petitioner are well founded. Hence, he urged that the petition be dismissed.

4. Heard the learned Legal Aid Counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record.
5. As seen from the record, this is the third bail application filed by the petitioner/Accused No.1. On the earlier occasions, a learned Single Judge of this Court, by order dated 06.11.2024 in Crl.P.No.6748 of 2024 and by
order dated 07.02.2025 in Crl.P.No.561 of 2025, dismissed the first and second bail applications filed by the petitioner after answering each and every contention raised by the learned counsel for the petitioner.
6. The alleged offence took place on 17.07.2024. The petitioner was arrested on 18.07.2024. After a thorough investigation, the charge sheet was filed on 31.05.2025. A perusal of the charge sheet and the other material on record prima facie discloses that the accusations against the petitioner are well founded. The contention of the learned counsel for the petitioner that the petitioner is suffering from a syncopal disorder cannot be accepted as a ground for grant of bail, as adequate medical treatment is available in prison during the period of judicial custody.

Having regard to the entire facts and circumstances of the case, the nature and gravity of the allegations levelled against the petitioner/Accused No.1, and in view of the fact that there is no change in the circumstances from the date of dismissal of the second bail application till the filing of the present (third) bail application, this Court is not inclined to enlarge the

petitioner/Accused No.1 on bail at this juncture. Accordingly, the Criminal Petition is liable to be dismissed.
8. However, since the petitioner has been in judicial custody for the past two years, the learned Trial Court is directed to take necessary steps to expedite the trial and dispose of the case as expeditiously as possible.
9. In the result, the Criminal Petition is dismissed.
