Heard the learned counsel for the appellant. 2. We would dispose of the appeal even without issuing notice to the respondent. 3. We would not incline to examine the facts of the case but with regard to the direction of the learned Single Judge alone to pay a sum of Rs.6,65,585/-. The learned single Judge had quantified the gratuity amount at Rs.6,65,585/- and the encashment of earned leave and HPL at Rs.10,76,768/- and had directed the appellants herein to release a sum of Rs.8 lakhs/- to the writ petitioner/respondent herein. The writ petition is still pending. 4. We would modify the order of the learned Single Judge by directing the appellants to release the gratuity amount, whatever that amount is due and payable, to the respondent herein. The learned Single Judge has also stated that any payment made would be subject to the result of the writ petition. We would maintain that particular observation of the learned Single Judge. 5.
