For Petitioner : Mr.J.Jeyakumaran For Respondents : Mrs.K.Porkodi Government Pleader ORDER This writ petition has been filed seeking a writ of mandamus directing the second respondent to disburse the withheld amount Rs.2,18,040/- to the petitioner as per the order passed by this Honble Court in WA(MD).Nos.1713 and 1714 of 2025 dated 27.06.2025, within a stipulated time frame fixed by this Court. 2. An amount of Rs.2,18,040/- has been withheld by the respondents in terms of the order dated 27.06.2025 passed by the Hon'ble Division Bench of this Court in WA(MD)Nos.1713 and 1714 of 2025 on the ground that an enquiry was pending against the petitioner on the allegation of causing loss to the tune of Rs.2,18,040/- to the Government, especially to the School Education Department. As the said enquiry was pending against the petitioner at the time of his retirement from service, 2/6 https://www.mhc.tn.gov.in/judis WP(MD). No.14072 of 2026 the Hon'ble Division Bench permitted the respondents to withhold the said benefit while directing disbursement of the remaining terminal benefits. As the School Education Department has not concluded the enquiry proceedings and no orders have been passed, the petitioner approached this Court by filing the present writ petition for the relief as noted above. 3. The only ground on which the said amount of Rs.2,18,040/- has been withheld is the pending disciplinary proceedings at the instance of School Education Department. 4.This matter has adjourned from time to time for filing counter affidavit by the respondents. 5. Today, when the matter is taken up for consideration, Mrs.K.Porkodi, learned Government Pleader appearing for the respondents submitted that the disciplinary proceedings that were initiated by the School Education Department were dropped vide the proceedings dated 17.02.2026 and it was informed that the enquiry proceedings have been dropped as the same was found to be beyond the 3/6 https://www.mhc.tn.gov.in/judis WP(MD). No.14072 of 2026 timeline prescribed in Rule 9 of Tamil Nadu Pension Rules. Thus, it is evident that the discplinary proceedings which is the basis for withholding an amount of Rs.2,18,040/- has now been concluded and there is no justification for the respondents to withhold the said amount any further. 6. In the light of the above, there cannot be any impediment for the respondents to release the amount of Rs.2,18,040/-, which was withheld from and out of the terminal benefits payable to the petitioner. In the circumstances, this writ petition is allowed directing the second respondent to disburse the withhold amount of Rs.2,18,040/- as expeditiously as possible, at any rate within a period of six weeks from the date of receipt of a copy of this order.
