Mr.G.Maheswara Rao, the learned counsel for the Petitioner, submits that the Petitioner is innocent of the alleged offence and he has been falsely implicated in the alleged offence. He has not committed any offence. He is law-abiding citizen. He has got fixed abode. It is further submitted that, after a thorough investigation, the charge sheet has been filed. The Petitioner undertakes to abide by any conditions that this Court may impose while granting bail to the Petitioner. Therefore, he prays that the present petition be allowed. 3. Per contra, Mr.K.Sandeep, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the petitioner and submitted that though the charge sheet has already been filed in the case, the 3 Dr.YLR,J Crl.P.No.5266 of 2026 Dated 08.07.2026 accusations against the petitioner are well founded. Hence, he urged that the petition be dismissed. 4. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 5. As seen from the record, the petitioner is the sole accused. It is alleged by the prosecution that he was found in possession and transporting 2.170 kgs of ganja illegally. After thorough investigation, the charge sheet has been filed and the same has been numbered as N.S.C.No.263 of 2026. The case is coming up for the appearance of the accused before the learned Trial Court. The petitioner was arrested on 05.04.2026 and has been in judicial custody for the past 94 days. The learned Assistant Public Prosecutor submits that the petitioner is a rowdy- sheet holder. There are altogether six cases registered against the petitioner, out of which three are under the provisions of ‘the NDPS Act’. 6. Having regard to the entire facts and circumstances of the case, the nature and gravity of the allegations levelled against the petitioner, and in view of the fact that the charge sheet has been filed, wherein the accusation against the petitioner is prima facie well-founded, this Court is not inclined to enlarge the petitioner/Accused on bail at this stage. Accordingly, the Criminal Petition is liable to be dismissed. 7. In the result, the Criminal Petition is dismissed. 4 Dr.YLR,J Crl.P.No.5266 of 2026 Dated 08.07.2026 As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR.
