APHC010340642026 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI WRIT APPEAL NO: 823 of 2026 Bench Sr.No:-39 [3584] Kandula Daniyelu ...Appellant Vs. The State Of Andhra Pradesh and Others ...Respondent(s) ********** Advocate for Appellant: Mr. Arun Showri G Advocate(s) for Respondent(s): GP for Home CORAM : THE CHIEF JUSTICE LISA GILL SRI JUSTICE CHALLA GUNARANJAN DATE : 14th July 2026 LISA GILL, CJ: Prayer in writ appeal is for setting aside order dated 01.05.2026, passed by learned Single Bench, whereby writ petition filed by present appellant has been disposed of while directing respondent No.7 to expedite the process in Crime No.08 of 2025 registered in Naguluppalapadu Police Station, Prakasam District, and to file appropriate proceedings before jurisdictional Magistrate in accordance with law. 2. When faced with question of maintainability of this appeal in view of judgment of Hon’ble the Supreme Court in Ram Kishan Fauji v. State of Haryana and others, (2017) 5 SCC 533, learned counsel for appellant 2 io_wa_823_2026 submits that there is another limb of prayer in the writ petition i.e., with regard to release of compensation amount in accordance with G.O.Ms.No.95, dated 29.08.2016. It is submitted that there is no discussion on this aspect by learned Single Bench, therefore, present appeal should be allowed. 3. We have heard learned counsel for parties. 4. We do not find any ground to cause interference in this matter. Primary prayer in writ petition has a distinct criminal flavour. Therefore, present appeal is not maintainable. In respect to question of no discussion or advertence by learned writ Court in regard to prayer for compensation, the same also does not warrant any interference by this Court. Appellant is at liberty to avail remedies available to him in accordance with law. Writ Appeal is accordingly disposed of. No costs. Pending miscellaneous applications, if any, shall stand closed.
