ORDER : The Court made the following order :- The petitioner/A9, who was arrested and remanded to judicial custody on 28.04.2026, for the offences punishable under Section 191(2), 191(3) and 103(1) of BNS, 2023, in Crime No.221 of 2026 on the file of the respondent 1/5 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD)No.14823 of 2026 Police, seeks bail. 2. The allegation against the petitioner is that he belongs to a gang operating in a village and that there is enmity between his gang and another gang. Hence, with a view to getting rid of the deceased, namely Maariselvam and after waiting for an opportunity, on the date of occurrence, they waylaid the deceased and attacked him with deadly weapons thereby committing the murder of the deceased. Hence, the case has been registered and the petitioner and other accused were arrested. 3.The learned counsel for the petitioner submitted that the petitioner herein has been arrayed as A9 in this case. He further submitted that the petitioner has been falsely implicated based on the confession statement. Even according to the said confession, it has only been stated that the conspiracy to murder the deceased was intimated to the petitioner herein and that he advised the parties to proceed and assured them that he would take care of the future consequences. Accordingly, the occurrence is alleged to have taken place. The learned counsel further submitted that a false case has been foisted against the petitioner, since the petitioner is having some previous cases. He would further submit that this Court dismissed his earlier application. Thereafter, the similarly placed accused persons namely A6 and A7 have been released on bail by the 2/5 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD)No.14823 of 2026 order dated 16.07.2026 in Crl.O.P.(MD).No.14558 of 2026. The investigation has also been concluded. Hence, there is change of circumstances and prays for of bail to the petitioner. 4.The learned Counsel for the State of TN (Crl. Side) appearing for the respondent Police submitted that totally nine accused in this case. The petitioner herein is ranked as A9. The petitioner is having nine previous cases. The petitioner is the habitual offender. The overt act attributed against other accused is different from the overt act attributed against this petitioner. Hence, he opposed to grant bail to the petitioner. 5.Heard the learned counsel on either sides and perused the materials available on records. 6. Considering the other circumstances, that the overt act attributed against the petitioner is different from others, the petitioner has nine previous cases, and this Court finds no change of circumstances to grant bail to the petitioner.
