No.14420 of 2026 judicial custody on 02.07.2026 for the offences punishable under Sections 318(4) of BNS and 66D of Information Technology (Amendment) Act, 2008, in Crime No.62 of 2026 on the file of the respondent police, seeks bail. 2. The case of the prosecution is that the petitioner herein is ranked as A1. The defacto complainant was invited through WhatsApp to invest in an online trading business, and accordingly, he was directed to deposit money into various accounts, including his friends, namely Arul Deepan, and a total sum of Rs.6,115,816/- was paid by the facto complainant, and subsequently, it was revealed that the amounts paid were not for online trading and it was an online fraud. On investigation, it was revealed that the petitioner has induced his friend, Arul Deepan, to share the victim's bank details. After sharing the bank details, a sum of Rs.15,00,000/- was also transferred to the account of Arul Deepan, and thereafter, a sum of Rs.3,70,000/- was transferred to the account of the petitioner from the account of Arul Deepan, and the remaining amount was transferred to another account, which was suggested by another accused one, Sam. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner has collected a sum of Rs.3,70,000/- from the money deposited into the account of his friend namely, Arul Deepan and only Arul Deepan has transferred the amount to the main accused and he is ready to co-operate with the investigation and he has been arrested and remanded to judicial custody on 02.07.2026. Therefore, prayed to grant bail for the petitioner. 4. The learned Government Advocate (Crl. Side), appearing for the respondent, reiterated the prosecution case and, on instructions, reported that the petitioner is the only person now available for investigation and the other accused are all absconding and it is a case of online fraud and the accounts of the various persons have been utilised and investigation is going on and if the petitioner is released on bail, he will indulge in a similar kind of offence. Hence, he opposed granting bail to the petitioner. 5. Considering the submissions made on both sides and also 3/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.14420 of 2026 perusal of the statement recorded from the petitioner, it reveals that the petitioner has not stated anything about the purpose for which the amount was paid into the bank account of Arul Deepan and he subsequently, transferred the same to the other accounts, including the commission amount, and so far no money has been recovered and the investigation in this case is pending, this Court is not inclined to grant bail to the petitioner. 6.
