ORDER The present writ petition has been filed seeking the issuance of a Writ of Mandamus directing respondents 1 and 2 to survey and subdivide the land comprised in Survey No. 46/5E2, to an extent of 5 cents out of 0.08.00 hectares, situated at Kasavanur Village, Viralimalai Taluk, Pudukkottai District and consequently transfer the patta in the name of the petitioner, based on the petitioner's application dated 06.06.2026. 2. The petitioner claims title to the property comprised in Old Survey No. 46/5FF, New Survey No. 46/5E2, to an extent of 5 cents out of 0.08.00 hectares, based on a Settlement Deed dated 29.05.2025, registered as Document No. 3511 of 2025, executed in his favour by his 2/6 https://www.mhc.tn.gov.in/judis grandmother, namely, Ammakannu. The said Ammakannu had purchased the property from one Kaviammal and Sankar under a Sale Deed dated 12.10.1995, registered as Document No. 1035 of 1995. Thus, the petitioner traces his title to the property through the aforesaid documents. The fourth respondent, who is the owner of the adjacent property, is interfering with the petitioner's peaceful possession and disputing the boundary of the property. Hence, the petitioner submitted an online application before the competent authority seeking survey of the property. However, the said application has not been considered till date. Hence, the present writ petition has been filed seeking appropriate directions. 3. In view of the above, the first respondent is directed to conduct a survey with the assistance of the second respondent after issuing notice to the petitioner, fourth respondent and any rival claimants, if any. If the first respondent requires police protection, the same shall be provided by the third respondent police. The official respondents shall adhere to the following Standard Operating Procedures: 3/6 https://www.mhc.tn.gov.in/judis • The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. • After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. • If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. 4.With the above observations, this Writ Petition is disposed of.
