The above prayer has been made on the ground that now, the matter has been settled between the applicant-appellant and the remaining surviving respondents. As such, a prayer has been made to exempt the applicant-appellant to bring on record the legal representatives of deceased respondent No.3. 3. In view of no objection, application under consideration is allowed and the appellant is exempted from bringing on record the legal representatives of respondent No.3-Charan Dass. Ordered accordingly. Application stands disposed of. CMP No.7487 of 2026 4. By way of the present application, which has jointly been moved by the appellant and respondents No.1 and 2, who are real brothers, a prayer has been made to permit the appellant to withdraw the appeal, in view of the compromise, which has taken place between the parties. 5. The application is duly supported by the affidavits of appellant-Lekh Raj, respondent No.1-Krishan Lal and respondent No.2, Ramesh Kumar. 3 ( 2026:HHC:12815 ) 6. The compromise has also been annexed with the application, as Ex.CX. 7. In view of the above, the appellant is permitted to withdraw the appeal. Application is disposed of accordingly. RSA No. 456 of 2014 8. In view of compromise Ex.CX, the present appeal is disposed of, being compromised. The compromise Ex.CX, be read, as part of the judgment.
