The case of the prosecution is that the defacto complainant is the wife of the first petitioner. Owing to matrimonial disputes, they have been living separately, and the defacto complainant has been residing with her son. It is alleged that, when the defacto complainant visited her matrimonial home to see her husband, who was suffering from illness, the accused persons assaulted her and caused injuries. Hence, the present case has been registered against the accused for the aforesaid offences. 3. The learned counsel appearing for the petitioners submitted that the present case has been falsely foisted against the petitioners. Considering the nature of the allegations, the fact that the petitioners have no previous criminal antecedents, and further taking into account that the occurrence appears to have arisen out of family dispute, this Court is inclined to grant anticipatory bail to the petitioners, subject to certain conditions. 3/6 https://www.mhc.tn.gov.in/judis CRL OP(MD).
