1. Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs :- 10.1 That an immediate order of stay be granted on the execution of the eviction order dated 07.04.2026 and the eviction warrant dated 07.04.2026 in Case No. Rev. Case. No.
2 202504110300072/ A 70, Year 2024-25 passed by Court of Tehsildar, Tilda-Nevra, District Raipur. 10.2 That an immediate order of stay be granted on the execution of the eviction order dated 07.04.2026 and the eviction warrant dated 30.03.2026 in Case No. Rev. Case. No. 202504110300073/A 70, Year 2024-25 passed by the Court of Tehsildar, Tilda – Nevra, District Raipur. 10.3 That both the impugned eviction orders dated 07.04.2026 be quashed and set aside by this Hon’ble Court in exercise of its writ jurisdiction under Article 226/227 of the Constitution of India. 10.4 That the Respondents be directed not to interfere with or obstruct the Petitioners’ possession over the disputed land bearing Khasra Nos. 570/1 and 570/2, Village Tandwa, Tehsil Tilda-Nevra, District Raipur. 10.5 That if the Petitioners wish to file a statutory appeal before the SDO/Collector, a period of 30 days be granted to them for the same and both eviction order warrants shall not be executed during the said period. 10.6 Any other relief which this Hon’ble Court may deem fit and proper may also be granted in favour of the petitioners.

Learned counsel appearing for the petitioners would submit that in two separate revenue proceedings, eviction order has been passed by Tahsildar, Tilda Nevra, District Raipur against the petitioners on 30.03.2026 and in pursuance thereof, dispossession warrant has been issued against them on same day i.e. on
30.03.2026. He further submits that aforesaid eviction order has been passed on the basis of demarcation report, which was carried out in absence of petitioners, therefore, order dated 30.03.2026 passed in both the revenue cases are illegal and bad in law, hence, he prays that this petition may be admitted for hearing. 3. In reply, learned counsel for respondent Nos. 1 to 3/State submits that though two separate orders have been passed in two different revenue cases, however, the petitioner has clubbed two different lands together in this petition and
3 therefore, this petition deserves to be dismissed on this ground alone. He further submits that aforesaid impugned order dated 30.03.2026 has been passed after providing due opportunity of hearing to the petitioner, which is appealable under Section 44 (1) of the C.G. Land Revenue Code, 1959, therefore, this petition is not maintainable. 4. In response, learned counsel for the petitioner submits that the petitioners are ready to file appeal before concerned Sub Divisional Officer (Revenue), but there is protest going on by the villagers and they have blocked the Tahsil Office, Tilda, therefore, he submits that at-least for 15 days interim protection may be granted. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Impugned order dated 30.3.2026 has been passed by Tahsildar, Tilda-Nevra, District Raipur (C.G.) in two separate revenue cases after providing due opportunity of hearing to the petitioner, thus, there is efficacious alternative remedy available to the petitioners to challenge the aforesaid order before concerned Sub Divisional Officer (Revenue), hence, this Court is not inclined to entertain this petition invoking extraordinary jurisdiction of this Court.
But, as contended by learned counsel for the petitioners that there is protest going on in Tahsil Office, Tilda, this regard and the petitioner has also filed photocopy of the same, therefore, in the interest of justice, it is directed that effect & operation of the impugned order dated 30.03.2026 along eviction notices shall remain stayed for a period of 15 days enabling petitioners to file appeal before SDO (Revenue), Tilda Nevra, District Raipur, from whom they can seek interim protection after filing appeal. 7. It is made clear that if the appeal is not filed within the stipulated period, then this interim protection granted in favour of the petitioner shall lose its efficacy. It is also made clear that after filing appeal, this interim protection will
4 no longer be available to the petitioner, as relief in this regard may be sought for by them from the concerned appellate authority. 8. With the aforesaid observations & directions, the writ petition stands
disposed of.
