CRL OP(MD). No.14083 of 2026 Sections 296(b) and 351(3) of BNS Act, 2023, r/w Section 3 of Tamil Nadu Property (Prevention of Damage and Los) Act, 1992, in Crime No. 230 of 2026, on the file of the respondent police seeks anticipatory bail.
2. The allegation against the petitioner is that the petitioner is the driver of the private bus. Due to a dispute between the defacto complainant, who is also the minibus driver, and the petitioner, the petitioner pelted stones at the windshield of the minibus and also caused damage to it. Hence, the case has been registered.
3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the the petitioner is is also a driver and he is not is ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.
4. The learned Counsel For State of TN (Crl.Side) appearing for the respondent police, reiterated the prosecution case, and on instructions, 2/4 https://www.mhc.tn.gov.in/judis
CRL OP(MD). No.14083 of 2026 reported that the petitioner is also having 4 previous cases and the investigation is at preliminary stage and the value of the property is Rs.20,000/- and the petitioner is having 4 previous cases. Hence, he opposed to grant anticipatory bail to the petitioner.
5. I have gone through the FIR and also the connected materials. 6.Considering the nature of allegations against the petitioner, and also considering the fact that the huge value of the property was damaged and the petitioner is a habitual offender and also having 4 previous cases, I am not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, this Criminal Original Petition stands dismissed.
