1. Mr. Ajay Veer Pundir, learned counsel for the petitioner through video conferencing and Mr. Ghanshyam Joshi, learned Additional CSC for the State.
2. The petitioner herein is the plaintiff of Suit No.76 of 2025 which was filed for permanent injunction in which on 20.03.2026 temporary injunction was granted in favour of the plaintiff.
3. It is argued by the learned counsel for the petitioner that despite the order of temporary injunction, the defendant raised construction over the suit property, consequently he moved an application under
Order XXXI X Rule 2A of CPC for initiation of contempt against the defendant which was registered as Misc. Case No.20 of 2025, on which the other side also put appearance, but they are adopting delaying tactics and raising construction.
4. By the instant petition, the petitioner is praying for expeditious disposal of Misc. Case No.20 of 2025.
5. The relief as sought in the writ petition appears to be innocuous.
6. Mr. Ghanshyam Joshi, learned Additional CSC, who put appearance on behalf of the respondent no.2 has no objection to the relief

7. In such view of the matter, instant writ petition is disposed of finally with the direction to the learned Civil Judge (Senior Division), Haridwar to expedite the proceeding of Misc. Case No.20 of 2025, Shahnawaz Rao vs. Amar Kumar and Another, as expeditiously as possible, preferably within one month from the date of production of certified copy of this
order.
