Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs :- 2 “10.1 That, this Hon'ble Cout may kindly be pleased to allow the writ petition and issue an appropriate writ, order or direction directing the respondents to immediately stop the discharge or untreated sewage water into Lemehari Talab situated at Raipura, ward No. 79, Raipur (C.G.) 10.2 That, this Hon'ble Court may kindly be pleased to direct the Respondents to give due preference and fair consideration to the Petitioner Society for re-allotment of the ponds at Raipura Ward No. 69, Raipur, being the previous licensee and a cooperative of local fisherman; 10.3 That, this Hon'ble Court may kindly be pleased to direct the respondents to make alternative arrangements for diversion of drainage water. 10.4 That, this Hon'ble Curt may kindly be pleased to direct the respondents to undertake clearing, desilting and restoration of the said pond within a time-bound manner. 10.5 That, this Hon'ble Court may kindly be pleased to, grant any other relief(s) deemed fit and proper in the interest of justice and equity. 2. Learned counsel appearing for the petitioner submits that 'Lemehai Pond' is a public water body used for religious and community purposes situated as Ward No. 69, Raipura, Raipur (C.G.), but untreated sewage is being discharged into the pond. The petitioner filed an application before respondents No. 3 & 4 /Municipal Corporation, Raipur to make 'Lemehai Pond' pollution free under Raipura Ward No. 69, but no action has been taken on this application, hence, learned counsel for the petitioner submits that this petition may be admitted for hearing. 3 3. In reply, learned counsel for respondents No. 3 & 4 would submit that relief No. 10.1 sought for by petitioner is holding the field of 'Public Interest Litigation' and relief No. 10.2 sought for by the petitioner is personal grievance, as no fishing lease was given to the petitioner, therefore, instant writ petition has been filed. 4. Having considered the reliefs sought for by the petitioner, this court is not inclined to entertain the instant writ petition. However, the petitioner is at liberty that if he wants to redress his relief No. 10.1, then he may file appropriate application in form of 'Public Interest Litigation' and if petitioner wants to redress his relief 10.2, then appropriate petition may be filed challenging not granting lease to the petitioner in respect of aforesaid pond for fishing activities. 5. In view of above discussion, the writ petition fails and is hereby dismissed. No cost(s).
