Mr. Balram Sharma, DSGI with Mr. Rajiv Sharma, Advocate, for the non- applicant/respondent.
An application has been filed under Section 29(A)(5) of the Arbitration and Conciliation Act, 1996, for extension of the mandate of the Arbitrator for passing the award.
The learned Arbitrator was appointed on 22.09.2023 and she entered into a reference on
19.10.2023. The pleadings were completed on
10.09.2024. The learned Arbitrator vide its order dated 20.08.2025 extended the mandate by six months, which expired on 10.03.2026. Perusal of the application would go on to show that the case is now fixed for final arguments.
The reasons given for the delay as such are on account of proceedings in an old criminal matter by the wife of the applicant, who is also an Advocate by profession, delayed the culmination of the proceedings by getting him arrested.
In these circumstances, this Court is of the opinion that it would be in the interest of justice to extend the mandate till 31.06.2026.
Accordingly, the application is allowed. The mandate is extended upto 31.06.2026. The application stands disposed of.
