For Petitioner(s): Mr.R.Kumaravel For Respondent(s): https://www.mhc.tn.gov.in/judis CRP No. 4043 of 2026 __________ Page2 of 4 ORDER This Civil Revision Petition (CRP) has been filed challenging the impugned order passed by the Additional District Munsif Court, Kallakurichi, in I.A.No.2 of 2025 in O.S.No.248 of 2021, dated 10.03.2026. 2. In the aforesaid order, the application filed by the petitioner, who is the third party, seeking to implead herself as the party 9th defendant in O.S.No.248 of 2021, has been dismissed, on the ground that the petitioner has got no legal right or interest in the suit schedule property. 3. Admittedly, the petitioner claims that she is the second wife of the deceased Chandran Boyan, and on that basis, I.A.No.2 of 2025 was filed by her. The trial Court has rightly dismissed the said application by holding that the petitioner, as the second wife, has no legal right or interest in the suit schedule property. Under the provisions of the Hindu Marriage Act, during the subsistence of a valid first marriage, the second marriage is void in the eye of law. Admittedly, even according to the petitioner, while the first wife of the deceased Chandran Boyan was alive, the petitioner is said to have married Chandran Boyan. https://www.mhc.tn.gov.in/judis CRP No. 4043 of 2026 __________ Page3 of 4 4. For the foregoing reasons, this Court does not find any infirmity in the reasoning given by the trial Court for dismissing the petitioner’s application. Accordingly, this Civil Revision Petition is dismissed. No Costs.
