M.Elumalai For Respondent(s): Mr.N.Palanivel, Govt.Advocate (Crl.Side) ****** https://www.mhc.tn.gov.in/judis CRL OP No. 18631 of 2026 __________ Page2 of 5 ORDER The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), r/w 20(b)(i)(A), of NDPS Act, in Crime No.95 of 2025, on the file of the respondent Police, seeks anticipatory bail. 2. The case of the prosecution is that, during a routine vehicle checkup, the petitioner along with other accused were found in possession of 100 grams of Ganja. Hence, the case. 3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner has been implicated based upon the confession statement and he is ready and willing to abide by any condition that may be imposed by this Court and hence, prayed to grant anticipatory bail to the petitioner. 4. The learned Government Advocate (Crl.Side), appearing for the respondent Police, reiterated the prosecution case and submitted that the https://www.mhc.tn.gov.in/judis CRL OP No. 18631 of 2026 __________ Page3 of 5 investigation is still pending. He would further submit that, if the petitioner is granted anticipatory bail, there is every likelihood of his absconding and indulging in similar offences in future. Therefore, he vehemently opposed the grant of anticipatory bail to the petitioner. 5. I have given my anxious consideration to either side submissions. 6. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the investigation is still pending. It is also evident that, if anticipatory bail is granted to the petitioner, it is likely to have an adverse impact on society. Considering the antecedents of the petitioner, the nature of the allegations and the interest of society at large, this Court is not inclined to grant anticipatory bail to the petitioner. 7.
