3. This writ petition has been filed by petitioner seeking a writ of mandamus directing the respondents to consider the claim of petitioner for transferring him in any of the places mentioned by him in paragraph no.7 of this writ petition.
4. It is the case of petitioner that he was appointed as Assistant Teacher on 06.09.2005. The petitioner has given details of his posting in paragraph nos.3 and 4, on the strength of which, it is argued that the petitioner remained posted in inaccessible areas since the very date of his appointment. The petitioner also gave an application in the prescribed format under the provisions of Uttarakhand Transfer Act for posting him in some accessible area, details whereof are given in paragraph no.7. Reliance has also been placed upon Section 10 of the Uttarakhand Government Annual Transfer Act according to which a government servant is entitled for transfer on completion of 10 years’ service.
5. In the given facts and circumstances of the case, present petition is disposed of by directing the respondent-State to decide the petitioner’s representation dated 27.04.2026 (Annexure No.3)

sympathetically, and to post him in any of the places mentioned in paragraph no.7 of petition or any other nearby accessible place, keeping in mind the fact that the petitioner has already served for 24 years in Durgam areas all throughout. Needless to say that the order be passed within one month from today in accordance with law after hearing the parties and by way of passing a speaking and reasoned order.
