The present writ petition has been filed by the petitioner with the following prayers:- “It is, therefore humbly prayed that this writ petition may kindly be accepted and allowed and the record pertaining to the case may be called for and:- i) by issuance of writ of mandamus, Debt Recovery Appellate Tribunal, New Delhi be directed to decide the “Regular Appeal bearing No. 04/2020 titled as Bank of Baroda Versus Smt. Beena Nathawat & Others”, within specified time period given by this Hon’ble Court. ii) Any other writ, order or direction which your lordships may deem fit and proper in favour of Petitioner may also be passed.” [2026:RJ-JP:14884] (2 of 2) [CW-16623/2024] 2. Learned counsel for the petitioner submits that as the Regular Appeal No.04/2020 is pending since the year 2020, the same may be decided in a time bound manner, strictly in accordance with law. 3. Learned counsel for the respondent – Bank, has expressed his objection to the relief as sought by the learned counsel for the petitioner. 4. Taking note of the above and considering that the petitioner is a senior citizen widow lady and without delving into the merits of the case, the learned Debt Recovery Appellate Tribunal, New Delhi, is directed to decide the Regular Appeal bearing No.04/2020, titled as Bank of Baroda Versus Smt. Beena Nathawat & Others, within a period of six months from today i.e., 09.04.2026, strictly in accordance with law. 5. With the aforesaid directions, the writ petition is disposed of. 6. Pending application(s), if any, stand disposed of. 7. Needless to say, this order has been passed only to decide the aforementioned appeal in a time bound manner and in no manner is to be construed as a direction to decide the same in a particular manner.
