The present criminal misc. application has been filed by the applicant with a prayer to quash/ set-aside the order dated 12.05.2026 passed by the court of learned 2nd Additional Sessions Judge, Kashipur, District Udham Singh Nagar in Criminal Revision Case No. 06 of 2026, Rupinder Kaur Vs. State and Another. 4. In this case, a complaint was filed under Section 173(3) of BNSS by respondent no. 2 which was rejected. Thereafter, respondent no. 2 preferred a revision against that order and Revisional Court set-aside the order of rejection passed by the Magistrate concerned and directed the Magistrate concerned to hold an inquiry afresh. Aggrieved by this order, the present criminal misc. application has been filed before this Court. 5. Learned counsel for the applicant would submit that applicant is innocent; that false and frivolous charges have been levelled against the applicant and that Revision Court, without appreciating the evidence on record set-aside the order of the learned Magistrate concerned and directed the Magistrate concerned to hold an inquiry afresh. 6. Heard learned counsel for the parties and perused the record. 7. Since, no order has been passed against the applicant, in such view of the matter, this Court finds no force in the submission made by learned counsel for the applicant and thus, this Court does not find any infirmity or illegality in the order dated 12.05.2026 passed by the court of learned 2nd Additional Sessions Judge, Kashipur, District Udham Singh Nagar in Criminal Revision Case No. 06 of 2026, Rupinder Kaur Vs. State and Another. Hence, this Court does not find any reason to interfere with the impugned order. 8. Accordingly, the criminal misc. application fails and is hereby dismissed.
