...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ of Mandamus or any other appropriate Writ, Order or Direction, declaring the inaction of the Respondent Nos.2 to 4 in not considering the petitioner's representation dated 11.06.2026 requesting them to inspect the petition schedule property situated in R.S. No. 178/4 (Old R.S. No.6/4), Chinagantyada Village, Gajuwaka Mandal, Visakhapatnam District, stop the unauthorized construction being carried on by the Respondent No.6 and 7 and take action in accordance with law, as illegal, arbitrary and violative of Articles 14 and 300-A of the Constitution of India, and consequently direct Respondent Nos.2 to 4 to consider the petitioner's representation dated 11.06.2026, inspect the petition schedule property, take appropriate action against the unauthorized construction being carried on by the Respondent No.6 and 7 in accordance with law, and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondent No.6 and 7 not to make any further construction in the petition schedule property and to maintain status quo, pending disposal of the above Writ Petition pending disposal of the above writ petition and to pass Counsel for the Petitioner:

The learned counsel for the petitioner submits that the petitioner's father is the absolute owner of land admeasuring to an extent of Ac.1.65 cents in Sy.No.178/4 of Chinagantyada Village, Gajuwaka Mandal. 2.
It is submitted that respondent Nos.5 to 7 have created certain documents and are claiming themselves to be the title holders by referring to a wrong survey number over an extent of 199 square yards and appear to have approached the 2nd respondent seeking building permission. It is submitted that the petitioner made a representation dated 11.06.2026 seeking the indulgence of the 2nd respondent to stop the unauthorized and illegal construction. 3. The learned counsel for the petitioner submits that the civil remedy against respondent Nos.5 to 7 will be redressed before the competent Civil Court. However, the unauthorized construction over the petitioner's property would have to be dealt with by the 2nd respondent. 4. The learned Standing Counsel appearing for respondent Nos.2 to 4, on oral instructions, submits that the petitioner has not submitted any title document along with the representation. It is submitted that the petitioner would have to submit the title documents, which would enable the respondents to correlate the petitioner's holding on the ground and also determine if any encroachment has been resorted to by respondent Nos.5 to 7 over the petitioner's property. It is submitted that respondent Nos.2 to 4 shall

conduct a proper survey, subject to the petitioner submitting the title documents. It is also submitted that the petitioner would have to submit a proper application and pay the requisite fee for conducting the survey. 5. Considering the submissions, this writ petition is disposed of, leaving it open for the petitioner to submit a fresh representation, along with copies of the title documents, as per the procedure for conducting the survey, within a period of two (02) weeks from the date of receipt of a copy of this order. Respondent Nos.2 to 4 shall issue notices to all concerned, including respondent Nos.5 to 7, conduct a survey, and demarcate the petitioner's property. Thereafter, respondent Nos.2 to 4 shall complete the process by following the due process of law as expeditiously as possible. There shall be no order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed. ____________________ JUSTICE HARINATH.N
