The petitioner herein is admittedly the tenant of the shop in question, for the eviction of which the respondent filed a release application under Section 21 (1)(A) of the U.P. Act No.13 of 1972, registered as PA Case No.1 of 2020, which was allowed on 20.05.2024, against which Rent Control Appeal No.2 of 2024 was preferred by the petitioner; and appeal was also dismissed on 10.04.2026, and aggrieved thereby, the instant writ petition has been moved. 2. On the previous date, both the parties were directed to get the instructions within how much period the petitioner will vacate the shop in question and how much period the landlord will propose the petitioner to vacate. 1 2026:UHC:3677 3. Mr. Piyush Garg, learned Counsel, initially proposes three years, but Mrs. Monika Pant, learned Counsel, appearing for the landlord proposes one year. 4. On their proposal, this Court is of the view that two years time is a reasonable period. The petitioner is also present in Court and makes a statement that he is ready to vacate the shop in question within two years from today. Apart from this, he undertakes that he will now pay the monthly rent of Rs.2,000/- instead of Rs.300/- from 01.06.2026. He also undertakes that he will give peaceful possession on or before 31.05.2028 and he will not sublet the shop to any other and to this extent he will file an undertaking before the Prescribed Authority within two weeks’ from today. 5.
