11.02.2026 IN THE HIGH COURT AT CALCUTTA Item No.14 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Allowed C.R.M. (R) 14 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 corresponding to Section 439 of the Code of Criminal Procedure, 1973 filed in connection with Misc. Case No. 197 of 2025 under Section 135 of the Customs Act, 1962. And In Re : Shri Varun Bansal ... Petitioner. Mr. Debasish Roy, Mr. L. Vishal Kumar, Mr. Rajnish Kumar Kalawatia, Mr. Abhimanyu Kunwar, Ms. Muskan Sharma ... For the Petitioner. Mr. Kaushik Dey, Mr. Tapan Bhanja ... For the DRI Authority. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 42 days and further detention of the petitioner is unwarranted. It has also been pointed out that the petitioner has cooperated with the investigation and there is no possibility of the complaint being filed very soon. Learned advocate appearing for the DRI authority, on the other hand, opposes the prayer for bail. I have taken into account the submissions of both the learned advocates and I find that the statutory period in such cases are sixty days. The petitioner is already in custody for 42 days. Some more time will be required by the DRI authorities to file their complaint having considered the 2 complexities involved in such type of investigation. As such, at this stage, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed on the following conditions. 1. The petitioner viz., Shri Varun Bansal shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Calcutta. 2. If on bail, the petitioner shall meet with the Investigating Officer of the case once a week as also when called for by the Investigating Officer. 3. The petitioner shall also not leave the jurisdiction of the learned Chief Judicial Magistrate, Calcutta except for attending the office of the Investigating Officer of the case till further orders of this Court. The application for bail, being CRM (R) 14 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
